MinDriveTime terms of service
This document is a starting template. Have a licensed attorney review it before launch.

These terms are an agreement between you and [Company legal name] ("MinDriveTime", "we", "us").
1. Acceptance and eligibility
By creating an account, subscribing, or using MinDriveTime at mindrivetime.com or through our mobile, watch, or desktop apps (together, the "Service"), you agree to these terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization (for example, a Fleet account), you confirm that you have authority to bind that organization, and "you" includes the organization.
2. What the Service does
MinDriveTime estimates the best minute to leave for drives you take regularly. It combines live traffic conditions, historical timing patterns, and routing data to suggest departure times and expected drive durations.
The optional Storm module surfaces severe-weather hazard information along your saved routes, such as hail, ice, high wind, and tornado risk indicators.
The Service learns your saved places and typical departure times privately on your device. It contributes only anonymized, aggregated corridor timing data to a shared cache, as described in our privacy policy.
All estimates are predictions. Traffic, weather, and road conditions change without warning, and the Service can be wrong.
3. Safety disclaimer
Read this section carefully.
MinDriveTime, including the Storm module, is an informational convenience. It is NOT a life-safety system, an emergency service, or an official warning system.
- The Storm module may be delayed, incomplete, or wrong. It may miss hazards entirely, and it may report hazards that do not exist.
- Always defer to official sources, including the National Weather Service and your local authorities, for weather warnings and emergency guidance.
- Do not use the Service to make any decision where weather could threaten life or property. If severe weather threatens, follow official warnings and instructions, not the app.
- The Service does not contact emergency services and cannot receive or relay emergency communications.
Do not interact with the Service while driving. The apps are designed for glanceable information only. Set your route before you drive. If you need to interact with the app, pull over safely first. You are responsible for complying with all laws on device use while driving, and you are always responsible for your own driving decisions.
4. Your account
You need an account for most features. You agree to:
- provide accurate information and keep it current;
- keep your credentials confidential and not share your account;
- tell us promptly at support@mindrivetime.com if you suspect unauthorized access.
You are responsible for activity under your account. We may suspend an account to protect the Service or other users.
5. Subscriptions and billing
5.1 Tiers

Current prices, feature lists, and any promotional pricing appear in the app and at mindrivetime.com. We do not restate prices here, so that this document cannot fall out of step with what you are actually charged. Prices exclude taxes, which we or the app store collect where required.
5.2 Where you buy affects the price
The price differs by platform. A subscription bought through the Apple App Store costs more than the same subscription bought on our website, because Apple charges us a commission on in-app purchases and that price includes it. We show you the exact price before you confirm any purchase.
Whichever platform you buy on, your subscription is tied to your account and works on all of them. If you already subscribe, signing in on another platform gives you what you already pay for at no extra cost, and we will not sell you a second subscription for it.
5.3 Free trials
Where we offer a free trial, its length is shown before you start it and you are not charged during it. Unless you cancel before the trial ends, the subscription begins and your payment method is charged at the price shown.
App store trials follow that store's rules. In particular, Apple allows one introductory offer per subscription group per customer, so if you have already used a trial you may not be eligible for another.
5.4 Auto-renewal
Paid subscriptions renew each billing period until you cancel. We (or the app store you purchased through) charge your payment method at the start of each period at the then-current price. If a price changes, we notify you before the change takes effect, and you can cancel before renewal.
5.5 How to cancel
- Purchased on the web (Stripe): cancel in account settings at mindrivetime.com, or email support@mindrivetime.com. Cancellation takes effect at the end of the current billing period.
- Purchased through the Apple App Store or Google Play: cancel through your store subscription settings. We cannot cancel store subscriptions for you.
After cancellation you keep paid features until the period ends, then your account moves to the Free tier.
5.6 Refunds
- App Store and Google Play purchases follow those stores' refund policies. Request refunds directly from Apple or Google; we do not control their decisions.
- Web purchases via Stripe follow our refund policy: contact support@mindrivetime.com within 14 days of a charge. We refund the current period if you have made no more than incidental use of paid features in that period. We may refund at our discretion outside this policy. Charges for metered usage you actually consumed are not refundable.
5.7 Payment processing
Stripe processes web payments. We never see or store your full card number. Your use of Stripe is subject to Stripe's own terms and privacy policy.
6. Acceptable use
You agree not to:
- use the Service while driving in any way that requires more than a glance;
- resell, redistribute, scrape, or bulk-export Service data, including predictions, traffic data, weather data, or corridor timing data;
- reverse engineer, decompile, or probe the Service except where law permits it despite this clause;
- interfere with the Service, other users, or our infrastructure, including rate-limit evasion and automated access outside documented interfaces;
- submit false or manipulated data to the shared corridor cache;
- use the Service for any unlawful purpose, or to track a person without their consent;
- share one account across multiple drivers outside a Fleet agreement.
We may throttle, suspend, or terminate accounts that violate this section.
7. Intellectual property
We and our licensors own the Service, including the apps, models, predictions, designs, and content. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own drives (or, under a Fleet agreement, your organization's drives) while these terms are in effect.
You keep ownership of the places and routes you save. You grant us a license to process them to run the Service for you, and to derive the anonymized, aggregated corridor timing data described in the privacy policy. That anonymized data is ours.
"MinDriveTime" and our logos are our trademarks. Do not use them without written permission.
If you send us feedback, we may use it without obligation to you.
8. Third-party data providers
The Service depends on third-party providers for traffic conditions, weather data, toll rates, mapping, and routing. Their data may be delayed, incomplete, or inaccurate, and coverage varies by region. We do not control these providers and are not responsible for their data. Toll estimates in particular may differ from what you are actually charged. Provider outages may degrade or interrupt the Service.
9. Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that predictions will be accurate, that hazard information will be complete or timely, or that the Service will be uninterrupted or error-free. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent the law allows:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost time, missed appointments, missed flights or events, vehicle damage, or personal injury arising from your use of or reliance on the Service.
- We are not liable for decisions you make based on departure-time predictions or Storm hazard information, including decisions made during severe weather.
- Our total liability for all claims arising out of the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $50.
Some jurisdictions do not allow certain liability limits, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot be limited by law.
11. Indemnification
You will defend and indemnify us, and hold us harmless, from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these terms, your misuse of the Service, or your violation of law or third-party rights, except to the extent we caused the claim.
12. Changes to the Service and these terms
We may change, add, or remove features, including third-party data sources, at any time. We may change these terms. For material changes we will notify you by email or in the app at least 14 days before the change takes effect. Continuing to use the Service after a change takes effect means you accept the new terms. If you do not accept, cancel and stop using the Service before the effective date.
13. Termination
You may stop using the Service and delete your account at any time in account settings or by emailing support@mindrivetime.com.
We may suspend or terminate your access if you violate these terms, if required by law, or if we discontinue the Service. If we terminate a paid subscription without cause, we will refund the unused portion of your current period for web purchases; store purchases follow the store's rules.
Sections that by their nature should survive termination do survive, including sections 3, 7, and 9 through 15.
14. Governing law and disputes
These terms are governed by the laws of the State of [STATE], without regard to conflict-of-laws rules. Courts located in [STATE] have exclusive jurisdiction over disputes arising from these terms or the Service, and both parties consent to venue there. Nothing in this section prevents either party from seeking relief in small claims court where eligible, and nothing waives rights that your local consumer law does not allow you to waive.
15. General
These terms, together with the privacy policy and any Fleet agreement, are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
